AOSCLICK is an online booking engine operated by Asian Overland Services Tours & Travel Sdn. Bhd. registered in Malaysia (registration no. 30613-D) of No. 39 & 40, Jalan Mamanda 9, Ampang Point, 68000 Ampang, Kuala Lumpur, Malaysia.
It is an innovative, powerful and friendly to use B2B hotel booking service, incorporating state-of-the-art technology and do not deal directly with the end consumer (the "Consumer").
To obtain a login ID, password and company code to access AOSCLICK reservation system, you must be a bona fide travel agent, tour operator, wholesale travel company or an airline providing ground services to its customers ("a Travel Agent"). We sell to Travel Agents, hotel accommodation, tours and any other related travel services, for onward sale by the Travel Agent to their Consumer. We do not supply, own or control the actual services which are to be sold. This contract is between the Travel Agent and Asian Overland Travel Services Tours & Travel Sdn. Bhd. ("we, us and our") where both parties are acting as principals.
By visiting, signing on as our Travel Agent, visiting this site or using this site, you hereby agree to and accept these terms.
i) CREDITA Travel Agent with an established credit facility ("Credit") will be provided with access to our room allotments to receive instant confirmations. To obtain Credit facilities, we would require a cash deposit or a bank guarantee (issued by an internationally recognized bank), to be given to Asian Overland Travel Services Tours & Travel Sdn. Bhd. A credit facility of 21 days for the value of the deposit or bank guarantee will be established and the Travel Agent will be provided with a login ID, password and company code. The Travel Agent will be responsible for maintaining and monitoring the activities of all their users as the relevant Travel Agent will be responsible for all bookings, payments and cancellation penalties incurred by all users.
ii) CANCELLATION DEADLINE & POLICY 1). Cancellation Deadlinei). For Credit Sales we will provide a Travel Agent with a cancellation deadline for the particular hotel booking the Travel Agent has purchased from us.
ii). To avoid cancellation penalties, the hotel booking should be cancelled before 12:00 noon local time of the Travel Agent. For example, a Travel Agent in Hong Kong should cancel the travel component booked in Singapore before 12:00 noon Hong Kong time.
iii). When a hotel booking is cancelled before the cancellation deadline, the status of the booking will be changed to "Cancel Confirm" and the Travel Agent will receive an email from us confirming that the travel component has been cancelled without penalty.
iv). If a booking is cancelled after the cancellation deadline has lapsed, the status of the booking will be changed to "Cancel Charge" and an email will be sent to the Travel Agent confirming receipt of the cancellation request.
v). When a Travel Agent makes a booking within the Cancellation Deadline, the payment for the booking is guaranteed by the Travel Agent.
vi). If the Travel Agent subsequently cancels this booking, the status of the booking will be changed to "Cancel Charge". A cancellation penalty may apply if the booking has already been confirmed and the status has not yet been updated by us and the Travel Agent cancels the booking even before the status has been updated.
vii). If we are unable to confirm the hotel booking, then the status will be changed to "Not Confirm". Details of the cancellation penalty if any will be advised in writing within 6 working days.
2). Payments1. A Travel Agent with a Credit Line will have access to view its credit limit and balance under "My Credit" after logging into the Website.
3). If Credit payments are not made as detailed in the paragraph entitled "Credit" above or the Travel Agent's credit limit has been exceeded, the online booking facility will be automatically suspended. To re-activate the account payment should be made or our finance department should be contacted.
4). CashA Travel Agent who does not have Credit facilities will not be provided with the online availability and will only be able to book only as "Room on request" provided the request is outside the cancellation deadline. If the required hotel is available, a confirmation will be sent to the customer with a "Due Date for Payment". The Travel Agent will be provided with a login ID, password and user name to make bookings on request. The Travel Agent will be responsible for maintaining and monitoring the activities of all their users as the relevant Travel Agent will be responsible for all bookings, payments before due dates and cancellation penalties incurred by all users.
5). Due Dates & Payments Due Datesi. Where we confirm a booking to a Travel Agent without credit facilities we will process the booking and provide a Due Date for Payment along with the invoiced amount payable at the time of confirmation.
ii. Payment must be made by cash, a bank draft or bank transfer in the currency of the invoice.
iii. If payment is not received by us on or before 12:00 noon local time of the Travel Agent on the Due Date for Payment, the respective hotel booking will be automatically cancelled without penalty.
iv. If proof of payment is received by us prior to 12:00 noon, local time of the Travel Agent, the booking will be reconfirmed and finalized.
v. If payment is made by a bank transfer, we would require a copy of the bank transfer details to be faxed along with a copy of the SWIFT message report prior to 12:00 noon, local time of the Travel Agent.
iii) RATES & CURRENCIES1). All rates quoted are net and non-commissionable, inclusive of all taxes and service charges.
2). Rates are quoted in US Dollars. The Travel Agent is also given a choice of receiving the rates as follows:
- US Dollars - MYRThe confirmation will be sent to the Travel Agent in the respective currency agreed and the invoice will be in the same currency. A statement of account will always be in Malaysian Ringgit or US Dollars as per the currency of choice.
3). We reserve the right to change prices offered on the site at any time but this will not affect the price of any bookings that have already been confirmed. The prices on the site are shown in the currency selected and displayed with rates of exchange calculated on a daily basis. Prices may change due to fluctuation of exchange rate levels.
IV) BOOKING PROCEDURES1). A maximum of 05 rooms and up to a maximum of 21 days per stay is allowed for each booking under the same name. Bookings for travel components above 10 days will always be "On Request" and will be processed manually.
2). Hotels are classified as 5 star, 4 star, 3 star, 2 star and 1 star. The classification is provided to us by the supplier of the hotel and we endeavor to validate and authenticate this information. However, the classification should be regarded as a general guide only. They are for information purposes only and are not a guarantee or warranty of any kind by us.
We cannot be held responsible for wrong and inaccurate information provided to us. Images, descriptions and a list of amenities/facilities are also provided and this information is obtained from the supplier of the hotel.
3). The number of guests on the booking must equate to the room type, e.g.: Single-1 Guest, Double or Twin-2 Guests, Triple - 3 Guests and Quad-4 Guests. Extra beds for adults and children can also be requested. Therefore, the total number of guests cannot exceed the number of beds requested.
For booking for children, the child age must be specified and may be booked as Child Share with or without extra bed. Most hotels permit a maximum of 2 adults and 1 child less than 12 years to share a room with or without an extra bed.
4). Rates for hotels and apartments are quoted on per room, per night basis and may INCLUDE BREAKFAST or may not include breakfast which will be stated as ROOM ONLY:
V) AMENDMENTS & CANCELLATIONS1). Amendments and cancellations can be made without any cancellation charges prior to the cancellation deadline/due date.
2). Any request for amendments or cancellation after the cancellation deadline/due date may incur cancellation penalties. Cancellation charges vary from supplier to supplier and can range from a minimum of 1 night stay to full charges for the entire stay. For bookings made during peak periods, trade fair periods, Conference periods..etc. will normally attract full cancellation penalties.
3). When booking is amended or cancelled, we will notify you within 6 working days of any amendment or cancellation charges.
4). The reason for providing you with the cancellation deadline or due date is to protect you from any cancellation charges and to alert you to make the amendment or cancellation before the cancellation deadline or due date.
VI) REFUNDS1). Refund requests will only be processed if received in writing within 30 days from the date the travel component was to be provided.
2). Refund requests for partially utilized services will not be processed unless we receive written proof from the service provider that the guest has not utilized all the services in full as specified on our final confirmation and that a refund will apply to the un-utilized services.
3). Refund requests for fully un-utilized services will be processed once we receive the written request. Refunds are subject to receiving confirmation from our supplier. The refundable amount provided by the supplier is final including cases when no refund is applicable.
4). We require a period of 21 days to process any refund requests. No claims would be entertained after a refund is processed.
VII) SIGHTSEEING TOURS & TRANSFERS1). Pick up times from accommodation and duration of all tours are approximate and are subject to traffic conditions.
2). Transfers are provided on the basis of one average sized suitcase and one piece of hand luggage per person. Travelers are responsible to pay directly for any supplement if more luggages are brought.
3). Suppliers of shared transfers reserve the right to alter services at short or no notice for any reason.
4). For transfers that include the services of a driver, the driver will not assist with check-in at the accommodation or at the airport, port or station unless specifically stated in the extended description.
5). The durations of all transfers are representative of the driving time in average driving conditions. We take no responsibility for a flight, train or other connection being missed should the duration of the service exceed that which we display due to circumstances beyond our control.
6). For booking of vehicles, no refund will be given for early return of your vehicle.
7). In case of cancellations and amendments of Shared Transfer services, 100% cancellation charges will apply to any shared transfer service.
8). Due to tight aviation security at the airport, travelers must contact us via the Airline or directly, if there is a flight delay of more than 2 hours or travelers are put on a different flight. Airlines will not release passenger flight information to us before flight arrival. There will be strictly no refund if we are not notified of such changes.
9). Tailor-made sightseeing with a driver and a local guide does not include any entrance fees. Local guides enter many attractions free of charge, but where Travellers' require their Guide to accompany them into an attraction, they may be asked to cover the guide's entrance fee as well as their own.
VIII) COMPLAINTSAny complaint regarding the supply of a service must be brought to the attention of the accommodation or service provider soonest possible during the Traveller's stay in order for rectification to be done. However if the matter is not resolved to your satisfaction, please notify us in writing by email within 1 month of the date of service. Any complaint received after 1 month of the date of service will not be investigated.
IX) CONFLICTSIf you place a booking with us, then the Booking Conditions apply to your contract with us. In the event of any inconsistency between the Booking Conditions and the Site Terms, the Booking Conditions prevail.
X) THIRD PARTIESReference in this site to any products, services, processes, trade names, trademarks or other information of third parties does not imply or constitute an endorsement, sponsorship or recommendation to you by us. Links to other sites not operated by us are solely for your convenience. We are not responsible for any products, services, processes, trade names, trademarks or other information provided by third parties.
XI) YOUR RESPONSIBILITY1). It is very important that you must keep secure any means of identification supplied to you by us, in order to use services on this site. You must supply accurate and not misleading information when using services on this site.
2). You warrant that you have obtained the necessary licences to operate your business as a Travel Agent in the relevant country and that you comply with all applicable laws and regulations in that country.
3). You shall be solely responsible for and hereby indemnify us, our parent company, directors, officers, employees and representatives against any and all claims, actions, demands, liabilities, losses, judgments, settlements, costs, damages, fines and expenses (including reasonable legal fees) in connection with, resulting from or arising out of: (i) your breach of any term, provision, representation, warranty or requirement of this Agreement; and (ii) any negligence or wilful misconduct by you, your agents or employees.
XII) DISCLAIMER & LIABILITY1). Information on our website are provided to us by suppliers and passed on by us in good faith and updated regularly, but we cannot guarantee its accuracy. We do not accept any liability to you or any third party for any error or omission on this site, nor do we accept liability for any loss incurred by a Travel Agent in relying on the descriptions. We may change, update or delete any information on this site without prior notice.
2). We do not warrant that this site will be uninterrupted, error free or that any information or other material accessible from this site is free of viruses or other harmful components.
3). We do not make any representation about the suitability of information, products and services on this site for any purpose. The site is provided on an "as is" and on an "as available" basis. You assume all responsibility and risk for use of this site.
4). We are not liable for any direct or indirect loss resulting from your use of the information on this site, except we shall be liable for death and personal injury resulting from our negligence.
XIII) ONWARD SALESOur contract for the sale of services is with the Travel Agent. A Consumer purchasing services contracts with the Travel Agent and not us ("Onward Sale"). The Onward Sale of services is the responsibility of the Travel Agent. We do not accept any liability for Onward Sales to a Consumer nor do we accept liability for anything which may go wrong with a booking. We are not responsible or liable for any dispute between the Travel Agent and a Consumer arising from the Onward Sale of a booking by the Travel Agent to a Consumer. If any claim is made against us following an Onward Sale by a Agent, that Travel Agent will indemnify us against all losses, fees, expenses and costs arising as a result of that claim. We are not liable to indemnify a Travel Agent other than in relation to any personal injury or death caused by our negligence. In particular we are not liable to indemnify a Travel Agent against any negligence, failing, fault or omission on the part of any supplier, owner or controller of any booking.
XIV) CHANGESWe reserve the right to change or modify these site terms at any time by posting such changes here.
XV) LAW AND JURISDICTIONThis contract and any matters arising from it shall be subject to law and exclusive jurisdiction of Malaysia.
XVI) FORCE MAJEUREThe Performance of this Agreement by either party is subject to acts of God, war, terrorism, government regulations, disaster, strikes, civil disorders, curtailment of transportation facilities, or other emergencies making it impractical, inadvisable, illegal or impossible to continue with the provision of the services booked. This agreement may be terminated without penalty for anyone or more of the foregoing reasons by written notice from one party.
